Industrial design expert on why Samsung is the copyist



Samsung has been called the copyist by Apple many times over, the first time in court documents the iPhone maker filed as part of patent infringement claims brought against its frenemy in April of 2011.
But evidence is mounting that Samsung slavishly copied some areas of the iPhone experience, like the iPhone’s gorgeous icons.
On Monday, Apple brought in an expert to testify before a northern California court where the iPhone and Galaxy makerslocked horns in the patent trial of the century…
Peter Bressler is a former president of the Industrial Designers Society and the founder and board chair of product design firm Bresslergroup.
Himself an inventor credited with inventing or co-inventing about 70 patents, Bressler testified today that, in his opinion, Samsung did in fact lift Apple’s designs for a few of its own smartphones and tablets.
He said, according to CNET‘s Josh Lowensohn:
My opinion (is) that there are a number of Samsung phones and two Samsungtablets that are substantially the same as the design in those (Apple) patents.
And what might those patents be?
According to The Verge:
One of the iPhone patents covers the flat, front face of the device while the other protects its rounded corners and the bezel Apple that ditched with the iPhone 4 design. The third design patent protects the iPad’s rounded corners, flat face, and the thin black border beneath the glass on the front of the tablet.
He went on further to opine that uninformed would-be buyers could easily confuse Samsung’s Galaxy-branded smartphones and tablet with Apple’s iPhone and iPad.
It’s my opinion that this phone, the design of this phone would be considered substantially the same when viewed by regular consumers.
His opinion especially pertains to Samsung’s first and second-generation Galaxy S smartphones.
What makes Bressler qualified to make such assessments?
According to his own words:
Industrial designers are trained to pay attention to a lot of the little details that work together to form the overall impression that the usual consumer would view. So (consumers) may see those details, but they tend to be somewhat subconscious to the overall view.
It was also discovered in the courtroom last week that an internal email circulated at Samsung following the iPhone’s debut five years ago, in which Samsung’s executives described the iPhone as causing a “crisis of design” at the company.
According to Forbes, the email message reads:
All this time we’ve been paying all our attention to Nokia, and concentrated our efforts on things like Folder, Bar, Slide, yet when our [product] is compared to the unexpected competitor Apple’s iPhone, the difference is truly that of Heaven and Earth.
It’s a crisis of design.
I also love this bit from Samsung’s email message:
When everybody (both consumers and the industry talk about [user experience], they weight it against the iPhone, the iPhone has becomes the standard.
That’s how things are already.
Asked by Apple’s attorney William Lee about its contents, chief strategy officer Justin Denison tried to downplay internal communication by calling it Samsung’s“hyperbolic” management style, to which Lee pointed out that the only documents that refer to a crisis in design refer to the iPhone.
In other legal news, Samsung also broke rules by taking witnesses to see the courtroom.
As this litigation drags out, Samsung is planning to launch the 10.1-inch Galaxy Note tablet later this month as it tries to solidify its position as the leading vendor of Android tablets, seen right above.

Building upon the original 5.3-inch Galaxy Note phablet, the upcoming Galaxy Note 10.1 is driven by Android 4.0 Ice Cream Sandwich and sports a 10.1-inch 1280-by-800 pixelsdisplay and a pen meant to “elevate a user’s creativity and productivity”.
It also has a 1.4GHz quad-core chip with 2GB of RAM, a five-megapixel back camera and a 1.9-megapixel one out the front. WiFi and cellular models will be offered, with threestorage options ( 16/32/64GB).
Samsung is also slated to update the 5.3-inch phablet with a 0.2 inch larger display and refreshed internals at a media event on August 29, two weeks before the next iPhoneannouncement.
Looks like it’s gonna be a busy fall, with the new iPhone coming and just about everyone else scrambling to spoil Apple’s party by outing their hero devices.

New images try to prove that Samsung copied Apple’s icons


As we begin week two of the high-profile patent trial between Apple and Samsung, we’re starting to see a lot more evidence submitted by both companies. And this next bit, filed by Apple, is particularly interesting.
In court today, Apple’s legal team presented 6 images to the jury that it believes proves that Samsung intentionally copied its iOS icons for use in its TouchWiz interface it installs in all of its popular Android handsets…
Handset-makers put these layers over Android to separate their devices from the competition (HTC has its Sense UI). But Apple believes that Samsung’s TouchWiz interface doesn’t make it unique, it makes it a copycat.
From the green Phone icon, to the purple Music icon with the eighth note and CD graphic, Apple makes a pretty compelling case. Even if you argue that graphics like a person’s silhouette or a gear have become universal symbols for Address Books and Settings apps, there’s no denying that Samsung’s designers got some inspiration from iOS here. If you’re looking for more proof, CNET has obtained all 6 images.
Apple’s done a great job thus far, outlining the many different ways it feels that Samsung has copied its products. But the trial is far from over. It’ll certainly be interesting to see how the jury interprets all of this evidence in the end.

Timbaland Criticizes Drake/Aaliyah Rumor

Timbaland spoke candidly with Power 105.1's The Breakfast Club about the alleged Aaliyah project that is reportedly set to be executive-produced by Drake. The superproducer said that he isn't a fan of the idea if it doesn't include him and Missy--who both actually collaborated with Aaliyah during her career.
"I know they trying to drop some Aaliyah records, but if he do it, it should be with me and him, and Missy," he said.
"I don't know what's going on," Timbo added. "The proper way to do that would be for me him and Missy to be all on the record."
No official statement has been issued regarding the supposed project, though it has been mentioned in Drake

Tyga Gets Face Tattoo?

Tyga got an 'interesting' face tattoo.
That's right, in the latest entry in the "Ridiculous Rapper Face Tattoos" trend, Tyga showed off his new facial ink in a web pic. The tribal artwork looks exactly like the signature face art sported by boxing legend Mike Tyson for the last several years.
"F*ck it #YoLo," tweeted Tyga.
There has been a lot of debate among Tyga's Twitter followers and fans who seemed to be reluctant to believe the ink was real. These days, with rappers sporting real and fake tats just to get a buzz on social media, you never can tell.

T.I. Pushes Back "Trouble Man"

T.I. pushed back his upcoming album, Trouble Man. The project, which will be something of a comeback for the "King of the South," was originally slated to drop in early September, but now it looks like it won't be released until near the end of the year.
"Me being the perfectionist that I am, I'm still tweaking and fine-tuning, trying to perfect all parts of this project," Tip told MTV News. "I did, like, 124 songs, and I've narrowed it down to 86 now, so now I have to continue to narrow down and continue to make it better. I'm not trying to paint myself into a corner with a date. I'm trying to make sure that the project is the absolute best it could be, and I'm trying to get it down by the end of the year."

Kreayshawn Pushes Her Album Back

Pop rapper Kreayshawn has delayed the release of her upcoming debut album Somethin 'Bout Kreay. The project is slated to be released September 18, and Kreay did unveil the official album cover artwork this week. She discussed the imagery in a recent interview.
"I wanted an album cover that would really help to represent me and who I am," notes Kreayshawn. "Something that, when people first see it, they'll say, 'Only Kreayshawn could think of a cover like that.'"
Kreayshawn burst onto the national stage via the YouTube hit "Gucci, Gucci" in early 2011 and has gained a reputation for outspokenness and visual arts wizardry.

Drake & Aaliyah Track Debuts

After hinting last week that he had a big project in the works involving late R&B superstar Aaliyah, Young Money rapperDrake released his first track alongside the fallen songbird. "Enough Said" hit the Web this weekend, with Drake rhyming and providing ad-libs over a signature Noah "40" Shebib track and the legendary starlet's trademark coos.
While the song received mixed reviews from fans online, it is most likely the first glimpse of a full-length posthumous release from Aaliyah.
According to reports, Aaliyah's family has given Drake their blessings to work on the singer's unreleased tracks. No release date has been announced for the expected full-length.
 

Luke Becomes High School Football Coach

Luther "Uncle Luke" Campbell has been officially certified to be a high school football coach. The former 2 Live Crew frontman has been working as an assistant, and according to AllHipHop, he finally attained his certification. The Florida Department of Education had withheld his status previously due to his raunchy reputation.
An administrative judge in Tallahassee certified Campbell as a head coach after he meets a series of conditions. He must pass ethics classes, prove that his child support payments are up-to-date and warn the judge up to 30 days in a advance when he plans to perform any sexually explicit material.
He's been an assistant for four years at two high schools in Liberty City.

Game Facing Lawsuit

Rapper Game is facing a lawsuit filed by producer Infamous over a mixtape beat. Infamous claims that he offered the track to Game in 2010 for the rap star to determine whether or not he wanted to use it on a project. The producer didn't hear word from Game, allegedly, but the song surfaced on his "Skate On" track from the "California Republic" mixtape.
Infamous has said that he attempted to reach Game, but reportedly the Compton rapper never responded.
The suit comes on the heels of another suit filed by superproducer RZA last year against Game over the song "Heartbreak." Infamous is looking for $100,000 in compensation.

Apple gave hackers access to user’s iCloud account


As we continue to upload more and more of our lives to the web, the dangers of being hacked multiply. Our credit card numbers, our home addresses — they’re all there for the taking. That’s why so many security experts preach using a complicated password.
But sometimes, using a strong password isn’t enough. Just ask former Gizmodo writer Mat Honan. Mat’s world was turned upside down this weekend when a hacker gained access to his iCloud account, wiping his Mac, iPhone and iPad, thanks to Apple…
If you follow Mat Honan or Gizmodo on Twitter, you would have seen quite the show Friday night. Hackers gained access to both accounts and started their reign of terror.
Honan explains how it all went down:
“At 4:50 PM, someone got into my iCloud account, reset the password and sent the confirmation message about the reset to the trash. My password was a 7 digit alphanumeric that I didn’t use elsewhere. When I set it up, years and years ago, that seemed pretty secure at the time. But it’s not. Especially given that I’ve been using it for, well, years and years.
The backup email address on my Gmail account is the same .mac email address. At 4:52 PM, they sent a Gmail password recovery email to the .mac account. Two minutes later, an email arrived notifying me that my Google Account password had changed.
At 5:00 PM, they remote wiped my iPhone. At 5:01 PM, they remote wiped my iPad. At 5:04, they remote wiped my MacBook Air.
A few minutes after that, they took over my Twitter. Because, a long time ago, I had linked my Twitter to Gizmodo’s they were then able to gain entry to that as well.”
And because he didn’t have any backups, Mat says he lost more than a year’s worth of photos, emails, and documents. Ouch. And apple said that none of this is recoverable without serious forensics.
So how did all of this happen? A brute force attack? A key logger? Nope, Apple essentially handed the hackers Mat’s iCloud password.
 ”Update three: I know how it was done now. Confirmed with both the hacker Apple. It wasn’t password related. They got in via Apple tech support and some clever social engineering that let them bypass security questions.”
Apparently, if someone can convince Apple that they are you, they can gain access to your iCloud account with very little effort. Granted, Mat Honan’s life is a little bit more public than most people’s (he’s also worked for Wired magazine). But this attack still highlights a very real weakness in Apple’s security.
In fact, we expect the company to make a statement regarding this situation at some point, if for no other reason then to reassure folks that this won’t happen again. Some people store their entire lives on iCloud. And if Apple ever wants to, at some point, become a medium for wireless mobile payments, it needs to feel safer.

Sprint says it won’t charge for FaceTime over cellular


There’s been a lot of talk over the past few days regarding AT&T and the new FaceTime over cellular feature in  iOS 6. The carrier has yet to deny accusations that it will charge customers extra for Apple’s video calling service.
But it looks like Sprint customers can rest easy. A spokesperson for the company has just confirmed that it has no intentions of charging their subscribers extra for the new FaceTime feature…
“Sprint Nextel Corp., which still offers unlimited data to new and existing users on its network, said it has no plans to erect pricing barriers to FaceTime.
“We are committed to our unlimited data and that means not charging for data consumption based on the application,” a spokeswoman said.”
As we’ve said before, Sprint’s dedication to unlimited data may prove to be pivotal for the carrier in the coming months. If the next iPhone, which is expected to drop sometime in October, really is LTE-capable, Sprint will have to find some way to market against carriers with bigger, faster 4G networks.
But with Verizon already in the process of nudging its customers off of legacy unlimitedplans, and AT&T recently announcing new data plans of its own, Sprint is certainly in a unique position. The question is, what will customers go for? Network speed and coverage, or bottomless data plans.

Possible next-gen iPhone prototypes surface in Bangkok


Apple’s iPhone media event isn’t expected to happen for another 6 weeks, but the tech world is fairly confident in what the handset is going to look like. Since May of this year, we’ve seen several parts surface from different sources that all point to the same two-tone design.
And more evidence of the theory has surfaced today. Some new pictures are starting to make their way around the web of what some folks believe to be a finalized prototype for the next iPhone…
9to5Mac points to the photos from Neowin. The site says that their source encountered the non-working handset at the MBK Center mall in Bangkok, Thailand.
“The pictures seem to confirm what we saw in the video, and after reaching out to the source (who is an ex-staff member from a long time ago) he confirmed that the iPhone is not a working device, but a “non functional replica prototype” and in his own words, “pretty accurate too.”
There’s obviously no way to confirm the legitimacy of these photos. And it’s very likely that the device is fake. But authentic or not, its design matches up perfectly with everything we’ve heard so far regarding Apple’s next smartphone.
With all of the evidence we’ve seen over the months, in favor of this design, it seems very likely that it’s accurate. And if not, well then Apple will have pulled off one of the biggest misdirections in history.

Sprint heavily discounts the iPhone 4S ahead of iPhone 5 launch


We just got words that Sprint was currently selling the iPhone 4S 16GB at a $50 discount, for a total price of $149.99. According to a Sprint retailer who reached out to us, the company has been notifying stores that this new pricing would be in place until September 14th.
The timing seems very appropriate as the iPhone 5 next iPhone has been rumored to be announced at an event on September 12th, and will supposedly be available for sale on September 21st…
Although the rumor has been confirmed by several media outlets, nothing is official until Tim Cook gets on stage to unveil Apple’s latest addition to the iPhone family.
Sprint is America’s third largest carrier. It is also the last US carrier to haven entered into an agreement with Apple to sell the iPhone, long after AT&T, and shortly after Verizon. Considered as the last carrier to offer true unlimited data plans, Sprint activated 1.5 million iPhones during the last quarter, far behind AT&T and Verizon.
From what we hear, this move is aimed at clearing up large inventories of iPhone 4S 16GB that Sprint committed to purchase from Apple, when it hoped it would generate sales as impressive as its competitors. Unfortunately for Sprint, this hasn’t really worked as planned so far.

Nicki Minaj Ready To Battle Lil Wayne

Nicki Minaj issued a playful challenge to her Young Money captain, Lil Wayne. With Wayne launching his Trukfit clothing line and Nicki also planning to throw her hat into the fashion game; Minaj says that Wayne should be scared of her as competition.
"The other day, me and Wayne were bashing each other. He was telling me that my clothing line better not copy off of his clothing line. And I was like, "Excuse me?" And he was just like bragging about his clothing line is at Macy's and we were just cracking up laughing. It's like, I'm so super proud of this man," she said. "I feel like there's nothing he can't do. Everything he does, he wins at it. His clothing line - my guy friends, you know, are already rocking Trukfit. It's interesting because things really happen overnight nowadays but, best believe, when my clothing line comes, I'm going to blow him out the park and he's probably going to be coming asking me for a job."

Eminem has a tremendous amount of respect for his longtime associate 50 Cent. Em spoke at-length about 50's drive to succeed and revealed that he's seen that spark in his friend and collaborator the entire time that they've been recording together.
"Ever since we started making music with Fif, it was kind of like a mutual respect thing and we became friends outside of the music," Em said of their bond.
"If you put the music aside, we can just talk about [anything], you know what I'm saying?" he continued. "50 is very big on the business aspect in his career. I would consider him a smart businessman. Not saying that I'm not, but I don't get into as much of the technical aspect in the business sense. Like, I have no idea what's going on. Ever. I don't even know where I'm at right now."

Rick Ross Discusses Young Jeezy

Rick Ross and fellow hip hop star Young Jeezy have had well-documented differences in the past. In 2010, Jeezy criticized Ross' claims that he was affiliated with the notorious Black Mafia Family on Ross' track "B.M.F.," but it seems like their feud has cooled in recent months. Nonetheless, Ross didn't exactly embrace the idea of possibly collaborating with The Snowman.
"You know where I'm at and the position I'm in right now, I don't have no beef with nobody. I'm chasing that crown right now," he said. "Right now ain't the time for that. We staying focused. I'm always 'bout business; that's why I'm here."
"I haven't taken nothin' personal since I came in the game and I think if you in this business and plan on having longevity in this you shouldn't take nothin' personal...ain't nobody stepped on my Jordans yet, not out here," Ross added. "As far as I'm concerned, bring that money bag, let's shake the world up, that's what Double M-G is about."

Snoop Dogg Is Now "Snoop Lion"

Rapper Snoop Dogg has officially announced his new moniker, Snoop Lion, and revealed that he is prepping his first reggae album, Reincarnated. The veteran hip hop star talked about his metamorphosis at Manhattan's Miss Lily's.
"I had no plans on going to Jamaica, making a Reggae record or nothing," he explained to the attending press. "The spirit called me...it told me to find something that's connected towards the Bob Marley spirit because I always thought I was Bob Marley reincarnated. It drew me to Jamaica."
"It's not Snoop Dogg on a Reggae track. I want to bury Snoop Dogg and become Snoop Lion. But I didn't know that until I went to the temple. The high priest, when I walked in, he asked what is my name. I said, 'Snoop Dogg.' He said, 'No more...You are the light. You are the Lion,'" he explained. "From that moment on, I had started to understand why I was there. We hadn't even recorded one song, but I was taking all of this information and spirit."
Reincarnated will also include a photo book shot by Los Angeles photographer Willie T and a documentary film created by VICE Media detailing Snoop's career.

Meek Mill Makes Court Appearance

Philadelphia-born rapper Meek Mill had to appear in court today (July 31st) as part of a routine hearing to deal with previous felony charges. The rapper, born Robert Williams, attended a status hearing for previous charges, for which he has served an eleven month prison sentence.
The conviction stems from gun and drug charges from 2008. Mill was previously paroled to house arrest but it has now been completed. Attorney Lou Savino told Fox 29 that the appearance was a routine hearing as a part of his probation.
Additionally, Mill was warned by the judge not to mention the D.A. handling his case in any of his lyrics. The rhymer had previously done so on his track, "The Ride."

A$AP Rocky Confident In Album

A$AP Rocky spoke proudly about his upcoming LongLiveA$APproject during a recent interview with Fuse. The rapper shared that he's poured himself completely into the album and doesn't think the media, fans or industry is prepared for what he has coming.
"There was a lot of blood, sweat and tears put into this project," he shared. "For the most part, I'm very happy but I've never been in this much pain in my life. All my pain was devoted and sacrificed for this project. This is the most passionate thing that I did...There's nothing out that's gonna be compatible to what I'm about to put out with this [album]. Nobody's project is gonna be touching this because it's not just Hip Hop. This is a revolution. This is a new start of something new. I embarked on something new...I don't think the world is ready for what I'm about to give them."
"I'm working on a documentary for London. It's gonna come on the news," he also shared. "They support me. I love London."

Rick Ross Salutes MMG, Health

Rick Ross appeared on BET's "106 & Park" to celebrate and promote the release of his new album, God Forgives, I Don't. During the appearance, Rozay took the time to show his appreciation to the fans and share his enthusiasm for his Maybach Music Group imprint's future.
"I think the first thing I should do is thank the fans and supporters," said Ross. "It's a big day for me. I want to say thank you."
"MMG, man. Just watching the whole MMG brand go to the next level, and we gotta welcome Rockie Fresh to the team. Shout out to Omarion. It's just exciting. Gunplay, murda!" he added.
The rapper also briefly alluded to his previous health concerns; he revealed that he's much healthier now. "Yeah, health-wise, I'm feeling a lot better," he said. "I'm gettin' a little sleep, you know what I'm saying? It's all love."

Nicki Minaj Involved In Dispute

Nicki Minaj is at the center of a dispute with the Zouk nightclub in Dallas, TX. The Young Money superstar was slated to appear at the venue following her performance at the Verizon Theatre in Grand Prairie, and promoters claim she signed a contract and was paid $30,000 but failed to appear.
Prior to the scheduled event, Nicki tweeted that there was no after party and warned her Twitter followers about fake promoters.
A club representative denied Nicki's insinuation. “From my understanding, she was outside, she had shown up, her security had done a walk-through and she just decided not to come in,” Zouk spokesperson Matt Cislo said. THe club is offering fans a refund, but hasn't stated whether or not it intends to sue for breach of contract.

Bow Wow Sued By Adult Film Star

Porn star Katsuni is suing Young Money rapper Bow Wow for stealing her dance moves and using them in his "Drank In My Cup" video. The French-Vietnamese starlet claims that she appeared as a club dancer in a music video for the French band Electronic Conspiracy and that Bow Wow stole several elements of her dancing for his video.
She also says that there is a Katsuni look-alike involved in 'intimate activities' with Bow Wow in his video.
She wants Bow Wow and music label Universal Music Group to pay more than $75,000 plus punitive damages for publicity rights violations, unfair business practices, false association and unjust enrichment.
